Overview

The products presented in the catalogues or on the company’s website are intended for the manufacture and installation of illuminated signs. Any use outside of this context, unless approved in writing by our services, excludes the guarantee of our company and would be at the buyer’s risk.

DEEE/ WEEE
The unique identification FR020256_05QJOT attesting to the registration in the register of producers of the EEE sector, in application of article L.541-10-13 of the Environment Code, has been attributed by the ADEME to the company YAKI (438 188 567 00046). This ID attests to its compliance with its obligation to register as a producer of Electrical and Electronic Equipment and to make its declarations of marketing to the ecosystem.

Prices
The selling prices are those of the price list excluding taxes in force at the date of dispatch requested by the customer. They are ex works and include standard packaging. Special packaging is invoiced at net prices. Prices may change under certain conditions: variation in raw material prices, exchange rates.

Complaints
Complaints should be addressed to LEDIT YAKI. Any goods returned to LEDIT YAKI will only be accepted carriage paid.

Free of charge
Metropolitan France excluding Corsica. Free shipping is granted for any shipment of catalogue material from our central stock, exceeding 850€ excluding VAT. Below this amount, a minimum contribution to transport costs of 27€ will be invoiced. For particular materials such as, for example, pharmacy crosses, displays, times, video screens, lengths greater than 2.5 m, for which the amount of shipping is specified in the catalogue, the amount of shipping will be charged directly to the customer.

Special packaging
All packaging other than a postal parcel is considered special packaging. Special packaging will be charged extra.

Delivery
All our goods travel at the recipient’s risk and are to be paid in Champlan (FR, 91).

Express shipments
A participation to the expenses is invoiced to the customer who wishes this mode of routing on a case by case basis.

Carrier claims
Our goods travel at the risk of the recipient. Consequently, to avoid any dispute, you must:
1. Count your parcels upon receipt.
2. Make accurate claims on the consignment note in the presence of the deliverer (attention to packages not damaged externally) (wet, crushed, broken, open, missing, damaged boxes, broken glass ...): the words “subject to unpacking” have no value.
3. Confirm these claims within 48 hours by registered letter with acknowledgement of receipt to the carrier (Double to our company).

Cash on delivery
The management costs of a cash on delivery shipment will be charged at 50€ excluding VAT.

Management fees
A handling fee of 22€ will be charged for orders under 100€.

Payment
For a first delivery, the departure of the goods is subject to their prior payment at the LEDIT YAKI headquarters in Champlan or Guangzhou CN. For subsequent deliveries, in the absence of a written agreement to the contrary, the payment of the goods is made by automatic LCR at 30 days. The payment term must remain compatible with a maximum outstanding amount agreed upon after analysis of the customer’s financial capacity or examination of the guarantees provided.

Late payment
By express agreement and unless a postponement is requested in time and granted by us, failure to pay for our supplies on the due date will result in :
1. The immediate payment of all the remaining sums due, whatever the method of payment provided,
2. The intervention of our collection services,
3. From the contractual deadline, the application of article L441-6 of the commercial code.  
A fixed indemnity of 40€ shall become payable as of right as well as the additional costs of collection without any prior formality. In addition, a penalty equal to the ECB rate plus 10 points will be claimed for late payment interest.
4. The implementation of the retention of title clause.
5. A penalty clause of 15% will be applied to the total amount due.

Default of payment
In the event of non-payment on the due date, the contract may also be automatically terminated by LEDIT YAKI by means of a formal notice sent by registered letter with acknowledgement of receipt, and the goods returned without delay. As a penalty clause, we reserve the right to apply a deduction of 15% on the value of the goods taken back if we have to implement the ownership clause.

Return
No returns are accepted except in the case of an order error reported within 8 days of receipt, provided that the products are catalogue in good condition. In this case, the round trip shipping and a contribution to the costs of 20% of the amount of the order will be deducted from the refund of the goods.

AFTER-SALES SERVICE
Returns must be sent to LEDIT YAKI for the attention of the after-sales service, with the round-trip shipping charge paid by our customers.
Compensation, if any, will always take into account the satisfaction to be given to the customer, but will never go beyond the replacement of the defective goods.

Warranty
Our products are covered by the legal Warranty against hidden defects. The Warranty is 1 year except for specified products.

Ownership Rights
Our sales of goods are concluded with ownership rights. The transfer of ownership occurs only after full payment of the price (the payment of the price means the effective collection). Acceptance of deliveries or documents relating to a delivery shall constitute acceptance of this clause. The purchaser is the custodian of the goods sold under ownership rights and accepts the risks. He/she shall insure them and be responsible for any liability as soon as the order is shipped. LEDIT YAKI may, by a simple letter sent by certified mail with acknowledgement of receipt to the customer, immediately activate its ownership clause and demand the immediate return of the goods and merchandise delivered and remaining unpaid. The customer will have to proceed, at his entire expense, to the immediate restitution of the goods without taking advantage of any damage. Any advance payments received will be retained by LEDIT YAKI as compensation for the damage suffered.

Jurisdiction
In case of dispute, whether we are the seller or the buyer, the Commercial Court of Évry will have exclusive jurisdiction, even in case of appeal in warranty or plurality of defendants.
Any order implies the full and unconditional acceptance of the customer to the present conditions.
